OUT WITH PGS AND IN WITH CIL
In previous editions of Property Focus we have covered the Government's proposals for Planning Gain Supplement (“PGS”). PGS has now been superseded by the Community Infrastructure Levy (“CIL”) which appeared in the recent Planning Bill.
The policy behind CIL is that infrastructure which is needed when an area is developed should be at least partly funded by the developers whose land increases in value as a result of the grant of planning permission. In addition to infrastructure costs, CIL will pay for local facilities such as schools and parks.
The proposed CIL will be standard charge made by local authorities on developments and calculated according to the number of new houses or square metres of development.
Section 106 Agreements will still be used, mainly to deal with affordable housing requirements.
