Unfair Dismissal, changes to qualifying period

The Department for Business, Innovation and Skills has confirmed that the increase in the qualifying period for unfair dismissal claims from one to two years will only apply to those starting a new job on or after 6th April 2012.

Currently, an employee has a right to bring an unfair dismissal claim after one year’s service. The guidelines indicate that this will remain the case for employees whose employment started before 6th April 2012.

This means that an employee with 11 months' service on that date will only have to wait one month before being able to make a claim for unfair dismissal.

The full guidelines are to be published shortly after parliamentary debate.
