George Davies advise Johnsons the Cleaners on Employment Appeal Tribunal matter
Manchester based law firm George Davies Solicitors LLP successfully defended an employment appeal claim on behalf of Liverpool dry cleaning firm Johnson Cleaners UK Limited.
The case, which is one of only 1500 cases nationally to go to the Employment Appeal Tribunal (EAT) in London this year, was brought by a disgruntled ex employee who had lost an unfair dismissal claim earlier in the year. She appealed on the grounds that she had not had a fair hearing under Article 6 of the European Convention on Human Rights. The bulk of her argument was based on the fact that an adjournment was refused resulting in her representing herself at the original hearing without her legal representative; therefore she believed the tribunal judge should have provided her with greater assistance.
The appeal tribunal, chaired by High Court Judge Mrs Justice Slade, found in favour of Johnsons at the hearing, dismissing the appeal.
Rachael Mongan, the solicitor at George Davies who advised Johnsons on this matter, commented: "From the outset of this case, complex and unexpected issues arose, including this appeal to the EAT. I was delighted that the appeal was dismissed and am now waiting to see if the Claimant decides to appeal further to the Court of Appeal."
Karen Castle, Head of Human Resources at Johnsons commented "This is the first time we have appeared at the EAT and I am thrilled with the result. We have used George Davies for employment law matters for a number of years and we have been extremely impressed with them. All of the lawyers in the team provide excellent service and we have achieved some great results with them."
